SMS MarketingCompliance: Guide

SMS Marketing and mass texting have become powerful tools to boost business growth. However, there are some regulations to follow before getting started with SMS marketing.

Things to Ponder to Maintain a Compliant Mass Texting Campaign

There are mainly two governing bodies in the U.S. every business should be aware of before beginning with SMS marketing.

1. Telephone Consumer Protection Act (TCPA)

The Telephone Consumer Protection Act (TCPA) is one of the key federal rules governing the telephone communications in the United States. Hence, any business planning to start SMS Marketing must comply with the TCPA. The following are a few requirements of TCPA for SMS Marketers.

  • Gain consent from consumers.
  • Make it easy for consumers to opt-out or unsubscribe.
  • Marketers should be careful regarding the time restrictions by the TCPA for sending text messages.
  • Use legitimate phone numbers for mass texting.
  • Scrub the Do Not Text list regularly to ensure your SMS marketing complies with TCPA.

2. Cellular Telecommunications Industry Association (CTIA)

CTIA represents the wireless communications industries in the United States. Although the CTIA is not a legal authority, its guidelines are consistent with TCPA regulations. Any business or individual not adhering to CTIA-compliant text messaging practices can be reported, resulting in the suspension or shutdown of the SMS campaign.
